10 Speed Automatic issues while on track

Ford rep finally got back to me this am, they denied my buyback claim as I have had no repair done to my vehicle yet. It overheated but that does not qualify at this point. Dealership just cleared the codes, toped off fluids and test drove ok, said they found nothing wrong.
They did not void my warranty. Whatever info they were looking for they evidently did not find.
They overlooked my safety concerns of it going into limp mode and shutting down on track. I'll have a nice lawsuit if I ever get rear ended on track huh?
Guess all I can do at this point is run it on track again, if it breaks it's under warranty, they can fix it....

I can't make any mods that will void my warranty, if I add cooling to rear, trans etc... that will void it.
Not sure if running distilled water instead of anti freeze will void warranty????

I hate to say it but this is their way of saying piss off. When i had the issue with my stock 5.0 smoking they made me jump hoops and eventually said it was normal. I traded the piece of shit in and took my chances with another one. Its been solid. As far as the lawsuit, thats just a chance you take getting on the track.

This is nuts. 'Test driven' at 30 mph around the block, tests...nothing. WOT for 30 mins on the dyno on a hot day, with loads of high rpm is getting closer to reality. My guess is, any warranty will be voided if used off road, on any track... whether timed ....or not.

Blow it up on track / or an accident on track, and you will be back to square one.
Then they will suggest you install a TON of cooling mods...as per the manual...(with no guarantee they will even work.... then what ? )

The dealer should take it back on spec, with perhaps slightly less $$.... factoring in age + mileage.
You may well take a slight loss now..... which may be cheaper in the long run.

This whole thing is nuts to me as well, and as I've stated several times PP1 pkg. they put Track Mode with Track Apps on it and tell you that you can only use it on track, add a larger radiator for additional cooling, 6 piston racing brakes and performance tires, but then not in the track use section of the manual but introduction, suggest not running on track unless you add additional cooling, but you can't add cooling because it will void your warranty, and also running on a road course may render repairs non-reimbursable under the warranty.
What a bait and switch scheme this is....

I remembered my car actually was worked on when I initially got it and had the 4 misfires and determined it had 4 bad spark sparks plugs. Does that qualify for a repair?

So I contacted my rep again and asked that, as well as I'm now adding the fact how serious a safety concern this is with the car shutting down and going into limp mode while on track, while running in Track Mode, which Ford states is to only be used on track.
The only way I would be able to duplicate the problem would be to go back on track in Track Mode, which I feel at this point is a very dangerous thing for me to do, as I have no idea when it might shutdown and could put myself, my car, and others on track with me at serious risk.
I'm waiting for response....

You sent them the link to the U-tube video... where it goes into limp mode... and tranny is hunting gears. What more do they want, outside temp at the time ? You will just get a repeat performance. 4 bad plugs IS a repair.

Yep I sent the video link, but my rep did not feel it was necessary to look at.... I was dumfounded....
So I sent it again today in my email to Ford the rep and this was one of my final statements:

I was sold a car that I was completely led to believe by Ford that was capable of running HPDE track days, with the High Performance Parts, Track Mode, and Track Apps. I have proven it is not capable as it shut down and went into limp mode while on track and in less than 15 minutes of my 2nd session.

I no longer feel safe to drive this car on a track for HPDE events as I have no warning of when it may shut down, which I have previously stated is a very dangerous thing to happen while on a track at speed. My car could be damaged and I could be very injured or killed. The only way I would be able to duplicate the problem I had with the car is to go on track with it again, which I feel would put myself, my car, and other Persons and Vehicles on track with me at danger. Once again I ask you to review my track video for this as it shows how dangerous this could be.

So this is the last response I received from Ford rep on Friday, not at all what they told me last week, but I will be pursuing all avenues I need to.

I understand what you have stated in your email however Ford does not make the decision’s regarding the buyback request. Ford follows the laws allotted by your state. If you believe your vehicle qualifies please contact the Better Business Bureau to proceed with further steps.

I lemoned out a focus RS last year and it has nothing to do with the BBB,look up your states rules on lemon laws and file proper paperwork if you qualify.(I sent Ford a registered letter)
Mine was inoperable for more than the time allowed,and was in for 3 or more times for the same repair( engine oil leak) after the headgasket replacement.
Iowa law gives us 2 yrs from purchase

Thanks for that info, I kinda suspected that same thing, I'm going to start looking into it today.

Sent registered letter,included the lemon buyback form ,downloaded from the internet,sent copies of repair receipts

This sucks, im sorry that you have had to go thru this bs.
Yes this does suck very much and I'm not looking forward to this process at all.

But we have forums like this to gather information and hopefully inform people so that others don't have the same problems.... I'm trying to be optimistic... :confused:
