If there was no court review or compensation of this property seizure, I would file a lawsuit immediately. The Gov't is prohibited from taking your property without compensation or legal review.

Sounds like a possible 4th Amendment violation to me.

Why not sell it for parts at least?

My bad, in their logic, these vehicles shouldn't have been produced in the first place. Why propagate the species...

I did not read anything in that link that was applicable to Commifornia being able to crush a car. Care to elaborate? Yea, they can seize it but i didn't read anywhere they had to give him money for it.

There have been legal cases in every State addressing the siezure of personal property. All ultimately lead back to the 4th Amendment. I don't have specifics, nor time to look them up at work. But the courts have ruled many times that the Gov't can't simple take your property without a warrant and legal review of the seizure of the property. Similar to "immanent domain" seizure the Gov't has to compensate for taking/denying personal property.

All I'm saying is this should be reviewed for legal standing. It may not be a legal seizure of property under the 4th Amendment. And as such he may be due compensation. Should he be punished for street racing. Yes. But did the Gov't have the right to deny him his personal property? I lean toward no.

They did that in San Antonio not too long ago as well. They were confiscating street racers' cars and crushing them. IIRC, I remember seeing atleast a few imports on video getting crushed, including an s2000

If it is legal, it shouldnt be. If that guy had a 5 year loan on that car he is screwed. Heavy fine, jail time, probation but not crushing his car. -Shane

Their was a mustang at the Knott's Ford show one year that left the event sideways. With 100's of people around crossing the road and almost causing a huge accident in the intersection, the cops took it right away. It was a complete show car too. The picture in the newspaper was the guy crying to his gf as his car was taken away on a flat bed

Their was a huge case that started because the state wanted to make an example out of him. It ended up not happening because of a good lawyer. But after this, we started hearing about many cars in the LA area getting crushed.

Their was a huge article in the news paper back in 03 I think about this law coming into high affect.

Funny, the street racing scene pretty much died shortly after

I don't know that I believe the story. There's no details about the incident, just that it was crushed for street racing. I think it is more realistic that they made sure this video would make it out there and people would be scared to street race.

At least it was just a Lexus! I don't think cops should be allowed to crush somebodys car for street racing, sure if there doing it on crowded roads or interstates arrest them, give a ticket and lock the car up and let them pay a fine. I guess kentuckys a little different about the laws cause we have a few cops that will sit out with us and watch the races and keep it safe.

One more reason that I won't ever call California home. It's pretty troubling hearing about this in San Antonio though... I would raise holy hell if the government did this to my car.

california seems to think they dont have to fallow federal law anymore and can make laws that go directly against them.


the guy should have had his car returned if all fines where paid on time and all legal remifications were satisified the pd had no right to do what they did. now if it had stolen parts then it should be crushed promptly.
