they just wont disclose it to the buyer of the car Im sure, "oh by the way, your awesome new 5.0 has no warranty coverage" smh. OP this is by no means a shot at you, I just know dealerships all to well

I came across a used 2011 with like 5k miles that looked great on auto trader...When I showed up to look at it I saw aftermaket AB's and a short throw on it that felt like garbage when I ran through the gears with the clutch in. Then when I popped the hood it was clear that the stock intake was removed and put back in...Im not talkin small scrates and rounded edges on bolts...the entire face of the strut mount area must have been so mauled that it was clobbered with touchup paint, and whoever did it did not do a good job at all.

I asked the sales guy how he got the car. His responce was, "Some guy came in and traded it for a 2012 model..." Me, "So let me get this straight..someone came in with this car, and left with the same car a year newer?" Sales guy, "Yes." Me, "Good luck."

This is the reson why I stopped looking for a used one...

I understand what your saying but Christ they won't even warranty ones that been tuned, why would they accept one back as a trade in? I understand buyer beware but man. Btw op that's great that you were able to do that. I wish I could find a mod friendly dealership around me.

Ya they just told me long it run and don't have no lights on cool. So I was like ok. The car is up and running. Just few last things to switch over or take off. Rims/shift light(to sell)/Areo force gauages/rest exhaust.

Auto is coming along pretty fast.

When I traded my '10 in they drove it about 150 feet, said "it looks good" and made an offer. They really don't care. Keep in mind that sales and service are two separate departments of most dealerships and have no control over each other.

I bet I could trade mine in with the blower and the dealer would still sell it as having the factory warranty. Salesmen/used car managers can really care less about and/or dont even know that Ford will void the warranty for powertrain mods.

Even though one local Ford dealer finally got smart, they make you sign a paper that states if the car was wrecked/repaired over a certain amount an you didnt disclose it, or if it was modified in any way to void the factory warranty you will agree to buy it back from them at used RETAIL.

Not sure how legally binding it is but I'm sure it scares a few people enough to trade elsewhere..

wow...so the dealer let you take the new car before you even gave them your old one!! man i gotta get a dealer like that. this is not directed towards the op but to those talking about the dealers not giving a shit on a trade...i was thinking about demodding mine and trading it in on a 12 gt500 my dealership had and they scoffed and said there was no way they would take mine on a trade knowing it was modded. mine only had 3500 miles on it too, so there are dealerships that wont touch em..from what ive found the only ones that do are the ones that take them without knowing there history.

beefcake, what do you do with the warranty? I mean obviously the the warranty is done once the ecm is tuned, do you disclose this to the potential buyer? just curious how this is handled

depends. the 12 was sold with the remainder of the factory warranty.

the 5.0 is no different than any car that has been sold for years.

Contained within these rules and regulations is Section 700.10, which states:

No warrantor may condition the continued validity of a warranty on the use of only authorized repair service and/or authorized replacement parts for non-warranty service and maintenance.

For example, provisions such as, "This warranty is void if service is performed by anyone other than an authorized 'ABC' dealer and all replacement parts must be genuine 'ABC' parts," and the like, are prohibited where the service or parts are not covered by the warranty.

These provisions violate the Act in two ways. First, they violate the section 102(c) ban against tying arrangements. Second, such provisions are deceptive under section 110 of the Act, because a warrantor cannot, as a matter of law, avoid liability under a written warranty where a defect is unrelated to the use by a consumer of "unauthorized" articles or service. This does not preclude a warrantor from expressly excluding liability for defects or damage caused by such "unauthorized" articles or service; nor does it preclude the warrantor from denying liability where the warrantor can demonstrate that the defect or damage was so caused.

Under the Magnuson-Moss Act, a dealer must prove, not just vocalize, that aftermarket equipment caused the need for repairs before it can deny warranty coverage. If the dealer cannot prove such a claim — or it proffers a questionable explanation — it is your legal right to demand compliance with the warranty. The Federal Trade Commission administers the Magnuson-Moss Act and monitors compliance with warranty law.
