Okay, so I apologize if this is miscategorized but I am a little heated right now.

So I bought my 08 GT a year ago from an infiniti dealership. When I bought the car they had a carfax for it that stated no issues with the car at all, and a clean title.

Went today to look at trading it in on a '12 GT and the guy handed me this.

Well, needless to say, I was not aware of it, and the salesman said that that drops the value in half, and that I basically got fucked on the deal.

At this point what legitimate options do I have?

Any and all advice appreciated!

This is why it's so important to do your own homework when purchasing a car. When someone is trying to sell you something, they're going to hide things like this. Even if you have the original paperwork showing what they claimed, you would have to prove in court they intentionally mislead you or lied to you. All they can say though is that was the information provided to them by Carfax at that time. Unless you can prove otherwise, you're screwed.

Find your original paperwork and go from there.

^^^That is what I did.

I bought my car from the dodge dealer and was told the car had never been in any wrecks. Took it to my uncles body shop and clearly it had been. Now that I found that out, I am going to court against the dealer for falsification of documents.

Not all accidents will show on a carfax report. If the repairs were made without using the insurance company, you won't see it on carfax.

Unibody/frame damage being announced at a auction doesn't mean the car has severe damage. Usually it is because there is a spot welded on the Frame/door jam and the guy that won it at te auction arbitrates it for that. Pm abdullagt500 for more information, he is much more experienced at this than I am.

The last Mannheim auction I bought a car at if the suspension was altered ie lowered or lifted it was redlit as frame damage.

Damn, I've got every last bit of paperwork from when I bought it. I just don't know if the dealership knew about it or not.

Nor do I have the money to have a lawyer and go through the legal avenues.

I figure I can just pay the car off and turn it into a race car, or keep it. I really do like the car, this just sucks, ya know?

I would try to sell it out right. But I would have a expert look the car over to see if there is any frame issues and if none found or minor see if they will write you their findings. So if the seller pulls a car fax you can hand them the report. Or staple the report to the carfax and give the seller a break on the price.
I could be way off but that is me. Recently my neice called me crying her car had blew a intake gasket ($750) on her skylark. The mech said that the head gasket is most likly next another ($1700) his advice was fix the intake gasket and sell it asap. Since the the car was only worth $2000 with no issues. But no way was I going to fix the intake gasket and sell it to some poor sob knowing that there is a very good chance the head gasket would blow. So I fix the intake gasket and told my niece drive it and if it blows we will go from there.
Long story short...sorry you got screwed but if your honest maybe you can still do ok on it and sleep at night .

Carfax can be up to 6 months late, so if you got into an accident today that accident could take time to show up on the report.

When dealers buy cars thru Manheim, they have Manheim do an inspection and they check for big stuff...frame damage is one of those things. Manheim can be wrong at times but for the most part they're spot on.

What you should attempt to find out is where did the Infiniti dealer buy the car from...Carfax most likely will have that where it'll show "sold at auction" and then you will see it listed in deaer's inventory about a month or so later. This will tell you they bought it from Manheim and most likely had an inspection done. I can tell you the dealer i worked for would NEVER buy a car with frame damage. I would expect Infiniti dealer would do the same and skip this car.

Basically, you should take the car to a shop now and have it inspected again to really find out if there is a damage and sell it out right. Fighting Carfax/Manheim/Dealer could take long time.

First off it's not a salvage title, is it? Check with the Washington DOL about options and disclosures. I'm sure the new Attorney General would love to help you out if he can. IIRC the address is www.dol.wa.gov

+1. Altered suspensions are often noted as frame damage on history reports. Perhaps the OP's car was not damaged at all, but simply lowered or had aftermarket suspension installed. Mustangs are quite commonly lowered, after all.

If they don't find any, what are my chances of convincing a dealership to take my car in on trade?

After you have proof of no frame damage, the dealership can put it on a lift and look for themselves. But that would be up to them.

i wonder how many dealerships would go to this trouble to help someone out? especially if they think they can get away with paying a lot less on trade.
